Prior Title Registers
Contents
Overview
Title Registers show subsisting details. This means that once a property is sold and registered in the names of the new owners, their ownership details are removed together with any mortgages or charges that have been redeemed ensuing from the sale.
Prior Title Registers
Realising that many people have legitimate reasons for checking details of previous owners, the Land Registry started retaining copies of Title Registers, which can be purchased as far back as 1993, or the date of First Registration if that was later.
Current title registers offer up-to-date information; prior copies hold unique value in understanding the historical context of property ownership and any changes that may have occurred over time.
Uses of a Prior Copy
Historical Ownership
Prior copies allow individuals to trace the historical ownership of a property, revealing previous owners and potential changes in ownership structure.
Evolution of Interests
By examining prior copies, one can track the evolution of legal interests affecting the property, such as mortgages, leases, or easements. Understanding how these interests have changed over time can be crucial for assessing the property's current status.
Identification of Restrictions
Prior copies often reveal any historical restrictions or obligations affecting the property, providing insights into its use and development over time. This information can be invaluable for property developers, planners, and homeowners alike.
Resolution of Disputes
In cases of boundary disputes or conflicting ownership claims, prior copies can serve as crucial evidence to support legal arguments and help resolve disputes effectively.
How a Prior Copy Differs from the Current Register
A Prior Title Register (or Prior Title Plan) looks identical to a current edition. The only difference in appearance is that it is a photocopy and will be posted to you rather than emailed. Otherwise it is an identical copy of the Title Register that shows the ownership details as at the date applied for.
