Boundaries

The Land Registry do not hold specific documents that describe property boundaries. Boundaries shown on the Title Plan are general boundaries only. Title Plans are sufficiently detailed to show an outline of the property and adjoining properties. Ownership of the land is illustrated by the marking of a coloured outline. The Title Register contains a note of the hectarage of the land and the OSI Map reference.

By an astute examination of all of the documents held by the Land Registry for a particular property and that adjoining it, the boundary positions can be gleaned with a reasonable degree of accuracy and obviate the need for litigation to resolve boundary disagreements and disputes.

There are 2 ways to describe property boundaries; there is a legal boundary and a physical boundary. The legal boundary consists of an invisible line which divides the two properties. The physical boundary comprises features on the ground such as a hedge or wall. The physical boundary may run on either side of, or through the centre line of a physical feature, and consequently this may give rise to difficulties in deducing the precise line of a boundary.

Whatever method is used to resolve a boundary dispute, the first step must be the examination of the documents held by the Land Registry for the properties in question. Most of the time the information provided is sufficient to resolve the dispute, particularly when one knows what to look for.

Guidelines for documents included with our Boundary Search

1 Title Folio (for each property)
This will provide a physical description of the property address. It may be no more than an address, but where the property includes land it may also describe detail of where the land is situated, e.g. land lying to the south of Berwick Road and to the east of Village Road and consisting of 5 acres. The Title Register may also make reference to Boundary Structure Notices. Rights of Way and Covenants may also provide clues as to a boundary position.

2 Title Plan (for each property)
This comprises an outline of the property curtilage, shown by coloured edging. Property boundaries are general boundaries only, i.e. not precisely defined.

3 Main Instrument (for each property)
It is the Instruments that will contain the most information relating to property boundaries. They need to be examined very carefully as they seldom refer directly to the boundaries and it is often necessary to look for hints and clues in the wording of covenants, easements and declarations. 4 Prior Titles
Prior Titles are former Titles under which the property was once held and may refer to previous ownerships or to a time when the property was part of a larger property. These are particularly important to look at as they are more likely to contain detailed descriptions of the boundaries as would be necessary when dividing separate parcels of land.
